FORCE MAJEURE: If blue pony photography cannot perform this agreement due to a fire, casualty, strike or other civil disturbance, Act of God, other causes beyond the control of the parities involved, or due to the Photographer’s illness, then blue pony photography shall return all monies paid by the client, but shall have no further liability with respect to this agreement. This limitation of liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or memory card malfunction, or otherwise lost or damaged. FAILURE TO PERFORM: Due to the limited and subjective nature of the event, blue pony photography cannot be held responsible for requested photographs not taken or missed, lack of coverage resulting from weather conditions, or schedule complications caused by, by not limited to, anyone in or at the event, or by the church or location restrictions. The Photographer is not responsible for lost photo opportunities due to other cameras or flashes, the lateness of the bride or groom, or other principles. Blue pony photography makes every effort to take requested photographs, it is acknowledged that any lists submitted to blue pony photography will be used for organizational purposes; no particular photograph is guaranteed. COPYRIGHT: Title (possession) of and copyright of all images shall remain with blue pony photography and hereby client has unlimited but non-exclusive rights to use or reproduce the photographs and may print or use them in any other suitable manner and share them with whomever they chose. However, client does not have right to claim work as own or sell work for monetary or other gains.  CREATIVE LICENSE: Images are edited at the discretion of blue pony photography. Delivered galleries may not include all images shot.The Photographer reserves the right to edit and release only those images deemed creditable as professional quality and within the Photographer’s artistic standards. MARKETING: Permission is hereby granted to blue pony photography to use any images created under this agreement for professional samples, displays, website pages, advertising, e-marketing campaigns, emails, social media, or any other purpose.  IMAGE STORAGE: Blue pony photography recommends backing up all images to an additional format, such as a hard drive or flash drive. Blue pony photography is not responsible for the storage of any images after they are delivered. PRINTING: Images must be downloaded from gallery prior to attempting to print images. All blue pony photography images are shot at the highest pixel count resulting in high-resolution images.  Image quality is directly proportional to facility being used to process photos, and blue pony photography can not be held responsible for subpar image processing.
